Terms and Conditions for WowCar Philippines

Effective Date: January 22, 2025

Welcome to WowCar Philippines! By accessing or using our website, mobile applications, or any services provided by WowCar Philippines (“the Platform”), you agree to comply with and be bound by the following terms and conditions (“Terms”). These Terms apply to all users of the Platform, including but not limited to visitors, buyers, sellers, and registered members.

Please read these Terms carefully before using the Platform. If you do not agree to these Terms, you should not access or use the Platform.

1. Definitions

“User” refers to anyone who accesses or uses the Platform, including buyers, sellers, and visitors.
“Platform” refers to the website and services provided by WowCar Philippines, accessible at wowcar.ph
“Dealers” refers to authorized businesses or individuals who list vehicles for sale on the Platform.
“Private Sellers” refers to individuals who list used vehicles for sale on the Platform.

2. Use of the Platform

Eligibility: You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are of legal age and have the legal capacity to enter into binding contracts.
Account Registration: To access certain features of the Platform, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Use Restrictions: You agree not to:
- Use the Platform for any illegal or unauthorized purpose.
- Violate any applicable local, state, or national laws in connection with your use of the Platform.
- Upload or transmit any harmful or unlawful material, including malware, viruses, or harmful code.
- Attempt to gain unauthorized access to the Platform or its servers.

3. Services Provided

Listing Services: The Platform allows Dealers and Private Sellers to list used cars for sale. WowCar Philippines acts as an intermediary by receiving payments from Dealers and Private Sellers. We do not facilitate direct car purchases or guarantee the sale or purchase of vehicles on the Platform.
Payments: WowCar Philippines may receive payments from Dealers or Private Sellers for transactions related to vehicle listings or other services provided on the Platform. We do not process payments for vehicle purchases made between buyers and sellers, and we do not take responsibility for the outcome of any transactions.

4. User Responsibilities

Accuracy of Listings: Sellers (Dealers and Private Sellers) are responsible for providing accurate and truthful information about the vehicles they list, including vehicle descriptions, pricing, and condition. Any discrepancies or issues related to the listed vehicle are the responsibility of the seller, not WowCar Philippines.
Buyer Responsibilities: Buyers are responsible for reviewing vehicle details, including any terms of sale and related conditions before making any payments or purchases. It is recommended to inspect the vehicle personally or arrange for an independent inspection prior to any financial commitment.

5. Intellectual Property

Platform Content: All content, design, graphics, logos, trademarks, and other intellectual property on the Platform are the property of WowCar Philippines or our licensors and are protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content from the Platform without explicit permission.
User-Generated Content: By submitting content (such as vehicle listings, reviews, or comments) to the Platform, you grant WowCar Philippines a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content for the purpose of operating the Platform.

6. Privacy and Data Protection

We are committed to protecting your personal information in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173). Our Privacy Policy outlines how we collect, use, and protect your personal data. By using the Platform, you consent to our collection and use of your data as described in the Privacy Policy.

7. Limitations of Liability

No Warranty: WowCar Philippines does not guarantee the accuracy, completeness, or reliability of the information provided on the Platform. All listings and transactions are conducted at the user’s own risk.
No Liability for Transactions: While we facilitate the listing process, we are not responsible for any disputes, damages, or losses that occur as a result of transactions between buyers and sellers.
Limitation of Liability: To the fullest extent permitted by law, WowCar Philippines, its affiliates, officers, employees, or agents will not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use or inability to use the Platform.

8. Indemnity

You agree to indemnify and hold harmless WowCar Philippines, its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses arising from your violation of these Terms or your use of the Platform, including any user-generated content you submit.

9. Termination

WowCar Philippines reserves the right to suspend or terminate your account or access to the Platform at any time, without notice, if you violate these Terms or engage in conduct that we deem harmful to the Platform or its users.

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Philippines. Any disputes arising out of or in connection with these Terms will be resolved in the courts of the Philippines.

11. Changes to These Terms

WowCar Philippines reserves the right to update or modify these Terms at any time. Any changes will be posted on this page, and the “Effective Date” at the top of this page will be updated accordingly. We encourage you to review these Terms periodically to stay informed about any changes.
